Terms of Service
Effective date: July 3, 2026
1. Acceptance of terms
By creating an account, accessing the OnFitt dashboard, or using the OnFitt API, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the service.
These Terms form a legally binding agreement between you (or the entity you represent, “Customer”) and OnFitt (“we”, “us”, “our”). If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation.
2. Description of service
OnFitt provides a virtual try-on API (“Service”) that allows fashion brands and e-commerce merchants to integrate virtual clothing try-on into their storefronts. The Service includes:
- A REST API for submitting product and shopper images and receiving AI-generated try-on results
- A JavaScript SDK widget for simplified storefront integration
- A web dashboard for managing API keys, monitoring usage, and viewing billing
The try-on generation feature is powered by Google Gemini, a third-party AI service operated by Google LLC. OnFitt acts as an intermediary: it receives your API request, forwards the image data to Google Gemini for processing, and returns the result to you. OnFitt does not independently perform AI inference.
3. Account registration
You must create an account with a valid email address before accessing the Service. You are responsible for maintaining the confidentiality of your login credentials and API keys.
You agree to provide accurate and complete registration information and to keep it updated. You are responsible for all activity that occurs under your account.
API keys are confidential. Do not share them publicly, commit them to version control, or embed them in client-side code that is accessible to end users beyond what is required for normal SDK operation. If a key is compromised, contact us immediately at hello@getonfitt.com.
4. Acceptable use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service for any illegal purpose or in violation of any applicable laws
- Submit images of individuals without their informed consent
- Submit images containing nudity, explicit content, or harmful material
- Attempt to reverse-engineer, decompile, or extract the underlying AI models
- Use the Service to train competing AI models or datasets
- Resell or sublicence API access to third parties without prior written consent
- Circumvent rate limits, usage caps, or authentication mechanisms
- Use the Service in a way that could harm, disable, or impair our infrastructure
- Misrepresent affiliation with OnFitt or use our branding without permission
We reserve the right to suspend or terminate accounts that violate these provisions without prior notice.
5. Plans, billing and payment
The Service is offered on a subscription basis. Pricing, plan limits, and features are described at getonfitt.com/pricing and may be updated from time to time with reasonable notice.
- The free Trial plan is limited to 100 try-ons over 14 days with no payment required
- Paid plans are billed monthly in advance
- Usage beyond your monthly plan limit may be billed at the per-request overage rate listed on your plan
- All fees are non-refundable except where required by law or at our sole discretion
- We may suspend the Service if payment is overdue by more than 7 days
You authorise us to charge your payment method on file for all applicable fees. It is your responsibility to ensure payment information remains current.
6. Trial period
The free Trial plan provides full API access for 14 days. At the end of the trial, your API key will be deactivated unless you upgrade to a paid plan. Try-on results generated during the trial period are not retained after account closure.
7. Third-party AI services and image processing
You acknowledge and agree that:
- The try-on feature relies on Google Gemini, a third-party AI service. OnFitt forwards image data to Google Gemini solely to fulfil try-on requests on your behalf.
- Shopper photos uploaded via the standard desktop flow are transmitted in-memory to Google Gemini and are not written to any OnFitt storage at any point.
- Shopper photos uploaded via the QR phone upload flow are stored temporarily in encrypted cloud storage for a maximum of 5 minutes while the desktop retrieves them, then deleted automatically. They are never retained beyond that transfer.
- Clothing images submitted to the try-on API are transmitted in-memory to Google Gemini and discarded immediately after the result is returned. They are not written to any OnFitt storage.
- Google Gemini's own Terms of Service and Privacy Policy govern its processing of image data. OnFitt has no control over, and is not responsible for, Google's data handling, retention, or use of data submitted to its APIs.
- OnFitt is not responsible for the accuracy, quality, or fitness for purpose of AI-generated try-on results produced by Google Gemini or any other AI inference provider.
- OnFitt is not liable for any service interruption, data loss, or harm arising from the unavailability, failure, or policy changes of Google Gemini or any other third-party AI infrastructure.
- You are responsible for ensuring that your use of the Service and the transmission of shopper image data to third-party AI providers complies with all applicable laws, including biometric data laws (e.g. Illinois BIPA, Texas CUBI), GDPR, and CCPA.
8. Intellectual property
OnFitt retains all ownership of the Service, its underlying technology, software, and documentation. These Terms do not grant you any intellectual property rights in the Service beyond the limited licence to use it as described herein.
You retain ownership of any product images and content you submit to the Service. By submitting content, you grant us a limited, non-exclusive, royalty-free licence to process it solely for the purpose of providing the Service.
AI-generated try-on output images returned by the Service may be used by you for legitimate commercial purposes (product pages, marketing materials) consistent with these Terms and applicable law.
9. Data and privacy
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
You are the data controller for personal data belonging to your shoppers (end users). OnFitt acts as a data processor on your behalf. You are solely responsible for:
- Ensuring you have a lawful basis for processing shopper image data under GDPR, CCPA, or other applicable law
- Disclosing to your shoppers that their images will be processed by AI technology and transmitted to third-party services including Google Gemini
- Obtaining any required consents, particularly in jurisdictions with biometric or facial data laws
- Maintaining a privacy policy on your storefront that accurately describes this data flow
10. Service availability
We aim to maintain high availability of the Service but do not guarantee uninterrupted access. Service availability depends in part on third-party infrastructure including Google Gemini, Vercel, and Google Firebase, over which we have no direct control.
Scheduled maintenance will be communicated in advance where possible. Enterprise plan customers may be subject to a separate SLA agreed at the time of contract. Standard and Starter plan customers are not covered by an uptime SLA.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.
We do not warrant that try-on results will be accurate, photorealistic, or suitable for any particular purpose. Virtual try-on outputs are AI-generated approximations produced by Google Gemini, a third-party AI model operated by Google LLC. OnFitt does not perform AI inference itself. Results may vary significantly based on image quality, clothing type, lighting, body shape, skin tone, and other factors outside our control.
AI bias and inaccuracy.AI-generated outputs, including try-on results, may contain inaccuracies, distortions, or outputs that do not accurately reflect real-world appearance. AI models, including Google Gemini, may produce results that vary in quality across different skin tones, body types, ages, or other demographic characteristics. Such variation is a known limitation of AI image generation technology. OnFitt does not endorse, condone, or take responsibility for outputs that are inaccurate, unrepresentative, or that could be perceived as discriminatory or biased. These characteristics are inherent to the underlying AI model and are outside OnFitt's control. We do not tolerate discrimination of any kind as a matter of policy, and any such output reflects the limitations of the AI provider, not OnFitt's values or intent.
You agree to present try-on results to your shoppers as approximate, AI-generated visualisations and not as accurate representations of how a garment will look or fit. You are responsible for any claims made to your end users about the accuracy of results.
We do not warrant that the Service will be free of errors, that defects will be corrected, or that the Service or its underlying infrastructure (including Google Gemini) will be continuously available or free of harmful components.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONFITT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR CUSTOMER RELATIONSHIPS, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY (TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE), EVEN IF ONFITT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, ONFITT IS NOT LIABLE FOR: (A) THE ACTIONS OR OMISSIONS OF GOOGLE GEMINI OR ANY OTHER THIRD-PARTY AI INFERENCE PROVIDER; (B) THE ACCURACY, QUALITY, OR OUTPUT OF AI-GENERATED TRY-ON RESULTS; (C) ANY DATA BREACH, LOSS, OR MISUSE OF DATA BY A THIRD-PARTY SERVICE PROVIDER; OR (D) ANY CLAIMS ARISING FROM YOUR FAILURE TO OBTAIN REQUIRED CONSENTS FROM YOUR END USERS.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS OR FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO ONFITT IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
13. Indemnification
You agree to indemnify, defend, and hold harmless OnFitt and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or relating to:
- Your use of the Service in violation of these Terms or applicable law
- Your violation of any third-party rights, including intellectual property rights or privacy rights
- Content or images you or your end users submit through the Service
- Your failure to obtain required consents from shoppers before processing their images
- Any claims by your end users arising from the use of the try-on feature on your storefront
14. Termination
You may terminate your account at any time by contacting us at hello@getonfitt.com. Upon termination, your API keys will be deactivated and your account data deleted within 90 days.
We may terminate or suspend your account immediately without notice if you breach these Terms, fail to pay fees, or if we are required to do so by law or regulation.
Sections 7, 8, 11, 12, 13, and 15 survive termination of these Terms.
15. Changes to the service and terms
We may modify these Terms at any time. For material changes, we will provide at least 14 days' notice by email to your registered address. Continued use of the Service after the notice period constitutes acceptance of the updated Terms.
We may also modify, suspend, or discontinue features of the Service with reasonable notice, except in cases of legal necessity or security incidents requiring immediate action.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts of Delaware, and you consent to the personal jurisdiction of such courts.
Before initiating any formal dispute proceedings, you agree to contact us at hello@getonfitt.com and attempt to resolve the dispute informally for at least 30 days.
17. General
These Terms, together with the Privacy Policy, constitute the entire agreement between you and OnFitt regarding the Service and supersede all prior agreements.
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
